Retailers frequently advertise massive "sales" by crossing out inflated, artificial “regular” or "before" prices that were never genuinely charged. Others bombard consumers with high-pressure countdown timers and email subject lines claiming an offer is "expiring" or that it is a "last chance" discount, only to quietly extend or repeat the exact same price the following morning. Under federal and state consumer protection statutes, including California false advertising laws, the restored Michigan Consumer Protection Act (MCPA), and Washington’s Commercial Electronic Mail Act (CEMA), these predatory dark patterns can constitute unlawful deceptive trade practices.
