  • Absolutely. There are well-recognized best practices for securing sensitive personal information.

  • We recommend that you closely monitor your credit report and your active accounts. Credit monitoring services can help with this, but it is usually unwise to accept credit monitoring service if you are required to sign away any claims in exchange for them. That is rare, but is just one of many reasons that you should consult with an experienced data privacy lawyer.

  • Often, you can't. In many situations, data breach claims are forced out of court and into private arbitration, and class actions usually are prohibited. In those cases (and many others) your best chance of recovery is to seek your own representation.

  • This is case specific, and in general it is almost always too early to say. In many data breach cases, individual payments can be significant. Of course, not all claims or cases are successful. An experienced complex case lawyer can help you maximize your recovery.
